Start-ups copy election campaigns: allowed or not? Askan Deutsch spoke to Horizont

Some companies are using the parties’ Bundestag election campaigns to publish their own (very similar) ads. Horizont spoke with Askan Deutsch, an expert for competition and brand law from the FPS Hamburg office about when “borrowing” an idea can become a legal problem. Mr. Deutsch sees a very good chance of success for a lawsuit against these company ads, but does not think any suits will be filed, because bad press just before an election is something no party wants. Mr. Deutsch also told Horizont that the companies would only serve to benefit from any media reports on these ads.
